Overview
This website is run by ROOTCLUB, operated by Root Club ("we", "us", "our"). We offer the site, and everything available through it, on the condition that you accept the terms, policies and notices set out here (the "Terms").
By visiting the site or buying from us you use our "Service" and agree to these Terms, including the policies they link to. They apply to everyone who uses the site: visitors, customers, vendors and anyone who contributes content. If you do not agree with all of them, please do not use the site or the Service.
New features and tools added to the store are covered by these Terms too. We may change any part of the Terms by posting an update here. Please check this page from time to time; continuing to use the site after a change means you accept it.
Our store is hosted on Shopify Inc., which provides the online platform we use to sell to you.
Section 1 - Online store terms
By agreeing to these Terms you confirm that you are at least the age of majority where you live, or that you have reached that age and consent to any minor in your care using the site.
You may not use our products for any illegal or unauthorised purpose, break any law in your jurisdiction while using the Service, or transmit viruses, worms or other destructive code. Breaking any of the Terms ends your right to use the Service immediately.
Section 2 - General conditions
We may refuse service to anyone, for any reason, at any time.
Your content, other than card details, may travel unencrypted across networks and be adapted to the technical needs of those networks. Card details are always encrypted in transit.
You may not copy, resell or exploit any part of the Service without our written permission. Section headings are for convenience only and do not affect the meaning of the Terms.
Section 3 - Accuracy, completeness and timeliness of information
The material on this site is general information. It should not be your only basis for a decision, and you rely on it at your own risk. Some information may be historical and is kept for reference only. We may change the site's content at any time and are not obliged to update it, so it is up to you to watch for changes.
Section 4 - Changes to the service and prices
Prices can change without notice. We may change or discontinue the Service, or any part of it, at any time without notice, and we are not liable to you or anyone else for a change, price change, suspension or discontinuation.
Section 5 - Products or services
Some products may be sold only online, may be available in limited quantities, and are covered by our refund policy.
We show product colours and images as accurately as we can, but we cannot promise your screen displays them exactly.
We may limit sales of any product to any person, region or jurisdiction, case by case, and may limit quantities. Descriptions and prices can change, and products can be withdrawn, at any time. An offer is void where it is prohibited.
We do not warrant that products or information you obtain from us will meet your expectations, or that every error in the Service will be corrected.
Section 6 - Accuracy of billing and account information
We may refuse any order, and may limit or cancel quantities per person, per household or per order, including orders that share an account, card, or billing or shipping address. If we change or cancel an order we may try to tell you at the email, billing address or phone number you gave us. We may also limit or refuse orders that look as if they were placed by dealers, resellers or distributors.
You agree to give current, complete and accurate purchase and account information, and to keep it up to date, including your email address and card details, so that we can complete your orders and reach you when we need to.
Section 7 - Optional tools
We may give you access to third-party tools that we do not monitor or control. They are provided "as is" and "as available", with no warranty or endorsement from us, and you use them at your own risk under the terms of the companies that provide them. New features and services we add later are covered by these Terms as well.
Section 8 - Third-party links
Some content, products and services available through the Service may include material from third parties, and links may take you to websites we are not affiliated with. We are not responsible for checking that material or those websites, and we are not liable for any harm connected with goods, services or content you obtain from them. Please read a third party's policies before you deal with it, and take any complaint about its products to that third party.
Section 9 - Payment authorisation and retry
- Authorisation. When you pay, the payment details are checked and the funds are confirmed with your card issuer.
- Retry. If a payment does not go through, we or our payment processor may attempt the charge again, once or more, within 24 hours.
- Notification. When a payment succeeds, you receive a confirmation email.
- Unresolved payments. If the payment still cannot be completed after the retries, no order is created.
- Security. Payments are handled to the PCI DSS security standard.
- Your part. Please keep your payment details current and make sure funds are available, to avoid a failed payment.
Section 10 - Comments, feedback and other submissions
If you send us ideas, suggestions, reviews, contest entries or other material, whether we asked for it or not, you agree that we may edit, copy, publish, distribute, translate and otherwise use it in any medium, without restriction. We have no duty to keep it confidential, to pay for it or to reply.
We may, but need not, monitor, edit or remove content we consider unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes someone's rights or these Terms.
You agree that your comments will not infringe any third party's rights, including copyright, trademark, privacy and personality rights; will not contain unlawful, abusive or obscene material or malicious code; and will not mislead us or anyone else about where they come from. You alone are responsible for your comments and their accuracy.
Section 11 - Personal information
Personal information you submit through the store is handled under our privacy policy.
Section 12 - Errors, inaccuracies and omissions
Now and then the site may contain a typing error, inaccuracy or omission about a product description, price, promotion, offer, shipping charge, transit time or availability. We may correct it, change the information, or cancel an affected order at any time without notice, including after you have placed the order. We are not obliged to update or clarify information on the site except where the law requires, and no update date should be read as a sign that everything has been revised.
Section 13 - Prohibited uses
As well as the other limits in these Terms, you may not use the site or its content to:
- act unlawfully, or ask others to;
- break any international, federal, state or local law or regulation;
- infringe our intellectual property rights or anyone else's;
- harass, abuse, insult, defame, intimidate or discriminate against anyone;
- submit false or misleading information;
- upload or transmit viruses or other malicious code;
- collect or track other people's personal information;
- spam, phish, scrape or crawl;
- serve an obscene or immoral purpose; or
- interfere with or get around the security features of the Service or of any related website.
We may end your use of the Service if you do any of these things.
Section 14 - Disclaimer of warranties; limitation of liability
We do not guarantee that the Service will be uninterrupted, timely, secure or free of errors, or that results obtained from it will be accurate or reliable. We may remove the Service for a period, or cancel it, at any time without notice.
You use the Service at your own risk. The Service and every product delivered through it are provided "as is" and "as available", without any warranty or condition, express or implied, including implied warranties of merchantability, quality, fitness for a particular purpose, durability, title and non-infringement, except where we have expressly said otherwise.
To the fullest extent the law allows, ROOTCLUB and its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers and licensors are not liable for any injury, loss or claim, or for any direct, indirect, incidental, punitive, special or consequential damages. This includes lost profits, revenue, savings or data and replacement costs, however they arise from your use of the Service or any product bought through it, even if we were told they were possible. Where a state or jurisdiction does not allow this exclusion or limit, our liability is limited to the maximum extent its law permits.
Section 15 - Indemnification
You agree to indemnify, defend and hold harmless ROOTCLUB and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, suppliers and employees from any claim or demand, including reasonable legal fees, made by a third party because of your breach of these Terms or your violation of any law or of a third party's rights.
Section 16 - Severability
If any part of these Terms is found unlawful, void or unenforceable, it is still enforced as far as the law allows, the unenforceable portion is treated as removed, and the rest of the Terms stays valid.
Section 17 - Termination
Obligations and liabilities that arose before termination survive it. These Terms apply until you or we end them. You may end them at any time by telling us you no longer wish to use the Service, or by ceasing to use the site. If we judge that you have failed to comply with any term, we may end this agreement without notice and deny you access to the Service; you remain liable for all amounts due up to that date.
Section 18 - Entire agreement
If we do not enforce a right or provision of these Terms, that is not a waiver of it. These Terms, together with the policies posted on this site, are the whole agreement between you and us about the Service and replace any earlier agreement, communication or proposal, including earlier versions of the Terms. Any ambiguity is not to be read against the party that drafted them.
Section 19 - Governing law
These Terms, and any separate agreement under which we provide you with the Service, are governed by the laws of the United States.
Section 20 - Changes to the terms of service
The current version of the Terms is always on this page. We may update, change or replace any part of them by posting the change here. It is your responsibility to check for changes, and using the site after a change is posted means you accept it.
